Focus...

Somehow, I think we are having difficulties in focusing to the right things when we are too carried away by things that's we are assigned to do. With all the 'works' that we are assigned to finish before the deadline, somehow, I realise, we focus on a wrong direction. Instead of God... we have put a lots of efforts to please the man... i.e. the leader. Oh well, I am not saying, we are wrong in fulfilling what we are assigned to do. We ought to finish our task given by our leaders anyway.... because as a servant, we are to submit ourselves to the leadership of our leaders. No question on this. However... when I was saying that... I then ask the question of who is our HEAD. Isn't that God? Hmm... and those who are serving Him including myself, ... aren't we the servant of God? So... are we not suppose to serve others? or wait... it should be each other, right? hehehe... see.. .I am again, confused. hahahaha....
Anyway.... I have 3 trials coming up... and I somehow need to get myself focus on 3 of them instead of 1. While I was telling my boss about the development of one of the file, I somehow updated him also on the other 2 and of course, he has been helpful in giving me some guidance. Oh well... it doesn't seems that it is possible for me to focus in one matter .. and therefore, I now re-locate my time to set apart a few hours for each of the files... seriously, it's not easy, especially when one of the client called up. hahahahhaha... so, focus focus focus is what I keep telling myself.
While I am trying to get myself focus, I just remember I need to also focus in those works I was assigned to finish... wow... it's going to be a very challenging month... !!!

Rights...

I am confuse of whether I have rights or not in certain things.... every time when I offended someone, the other party got angry at me and I thought, they have the rights to get angry and yield at me... sometimes... but for many occasions, I think I got very upset and angry when words was spoken on me like they have the rights to said those to me and/or I will never get angry (that they will not bother about my feelings) and it's like I do not have the rights to get angry. If I do, that's what I am getting now, that I am in my own room, blogging... while everyone else having their fun time on weekend. My ONLY weekend is spoiled first by the words other party spoken on me, secondly, by me getting angry. I wonder, I seriously wonder if I can be a bit humaine to feel angry sometimes. I am not a puppet, ok? I am too, not a toy... I am not mean to be in this world to be 'played' with.... and worse still, I cannot show my feelings. I can be sadden by words spoken on me... just like you do. ok? I am a human being... or may be, yes... you never treat me as one 'normal' human being... but I am... just in case you miss the point. So, can I feel upset?

Do you know your job?

Some of us probably just started your 1st or 2nd year of working whereas some of us, we have been working for more than 5 years now and therefore, some of us are still in the 'lowest' possition and some of us, are bosses or somebody's superior. Be where you are, I wonder if you ever ask yourself if you know what you are doing....
It's rather 'dissatisfying' when I was approached by someone who tell me how to fulfil their PROCEDURE REQUIREMENT rather than helping me to get what I want. I am not sure if you encounter such a situation. Not that they will lost anything if they grant me what is belong to me... but still, they want me to fulfil their PROCEDURE REQUIREMENT which they claimed it's set by KL (the only answer given).
I asked the purpose of those documents she requested and why can't the documents certified true copy by the lawyer or commissioner or judge, the ONLY answer I get was, "It's the procedure that I need to follow which is set by KL". For a moment, I really wanted to ask if she understand what her job is .... Obviously, besides asking people to fulfil the requirement she get from KL, she doesn't know anything about her job.... Seriously, I almost wanted to ask her if she understand what is certified true copy means? Which Law governs that, why can't she believes a judge who signed on it? etc.....
May be it's me, or may be I am trained in such a way to not just follow blindly when I was given instruction. I normally took extra efforts trying to understand the reason of such requirement, trying to understand why does it need to be that way and not the other way. Seriously, thank God she is not working under me, otherwise, she is fired.
Of course my friend's comment months ago reminded me. That is "If they are as good as you, they won't be working in that position today". Trust me, they do not even understand a loan account can be a current account these days, which I do not understand why they can failed to understand this simple knowledge. Oh well, I didn't argue much or tried to explained more, I just got up from the seat and left. Together with me, was a friend, and she was even more furious than me...
I being not understanding? May be... May be I expect everyone who works in their position to know what they are doing and why they are doing that for and when they do not know about the things their client/customer asked, a mere "I don't know, I am sorry" can be answered instead and not trying to dig out some "Procedure" as answer and blame KL for it.
I am of course not asking everyone to know everything... no one knows everything....! Come and ask me about some shipping law, I know nothing about it too. But ... if I need to do that, I will try to understand them fully. Won't you?

Still...

I am still considered 'busy' even though, instead of drafting, I am now waiting for the documents to be served on me as my client's solicitor and thereafter, I will have to compile some documents to be filed into court. Today is the deadline for one of the submission to be filed in Magistrate's Court Labuan. Yesterday was therefore, a busy day doing all the printing, binding and also writing of letters. Tomorrow will be deadline for another 3 documents to be filed to Court but I guess, by now, my new office boy who was so eager to finish some work, has filed it to the Court. So, we only left the work to serve to my opponent tomorrow. Hai.... there is another matter which is to be filed by next Monday and my clients somehow, take his own sweet time in looking and approving the documents. Oh well, I hope they know what they are doing as I probably won't be free after tomorrow.
It's a shame that the LHDN's system was down for WEEKS.... clients have been chasing for their documents and this LHDN has not been very co-operative and hence, I am getting some of the calls not to scold LHDN, but us instead....

One after another...

Yes.... just when I thought I can have time to prepare myself for the trial in Tawau which was fixed on the end of June, the court has in the morning, fixed another trial on 8th of June 2009. Yes, 2009, not 2010. I am not so sure why is this Court being so efficient, to the point where, I wasn't expecting that I need to prepare anything for NOW. Oh well, as the date is so short, that the both parties are to file their witnesse statements within 7 days. I have gottan my witnesses to come to my office right after my court this morning and I am now in the midst to prepare all of them by tomorrow morning.
Just while I was rushing to finish some other files, one of my file's defendant's lawyer called up asked me why didn't I reply the Defence he filed in April. To my shock, I opened the file and I realised, I did filed in court and it was to be arranged to serve a copy on him too, but ... obviously, he wasn't served a copy. I realise later that, it's the office boy that we sacked 2 days ago that filed the same documents to the court instead of serving one to the defendant's lawyer. I apologise to him and I said I will serve a copy for him later. He is however, laughed at me said, I must be too busy with things (I like senior and ethical lawyer, seriously). And because this lawyer called me up, I realise, I actually do have court matter tomorrow morning...
No choice, I have to then try to sort out my witness statement by tonight... thanks to DY who is cooking the meal now...

Fight!

As I was preparing myself for the trials, which I think I have made so much thinking and I forgot about checking the documents I need to bring to Labuan and and forgot even to print out my flight tickets. hahaha... Oh well, thank God I have itouch which has all my emails downloaded to the device. Well, and thank God my boss gave a copy of the document to our client in Labuan before and so, at least, I have a copy even though I really forgot to take a copy with me.
Well, 2 cases in one day. Seriously, it's very tiring. However, the first case has taken quite some time and I almost failed in bringing up my point. Of course, the Magistrates wasn't satisfied with some of my questions (i did that on purpose) and some, without the objection of my opponenet, he too, allow me to continue for quite some time.
I was put into a situation where I need to use our national language for the 2 trials in questioning/cross-examining the Prosecution's witnesses. I must say, my national language is rusted. hahahaha... however, during the second trials in the afternoon, all words came into mind, which's good. It's a good fight seriously... and I think I was a bit too agressive (my client think) trying to cause the Magistrates to dismiss the case with cost. Obviously I didn't success, but at least, I manage to cause the Prosecution to stand down the case to get advice and further instruction from the DPP. I hold it as a success. At least, I have proof and established my case well. The Prosecution cannot drop the case there and then as they always need approval from the DPP and that's what exactly they intent to do. So, I hope, and pray that the DPP will upon the advice of the Prosecution, drop the case.
I prepared some questions to ask the Prosecution witnesses, but seriously.... I didn't even look at any of the word thereof. No.. don't get me wrong. I am not proud of myself... but instead, I think it's not a very good practice. At least, I almost lost my point in the first trial. I should do better next time.
Oh well, ... it's a long day...and I think I better to and rest now. There's more thing to be done by tomorrow (after not being in the office for 2 days, I can imagine) .... errrrg........!!!!

Something new!

There's always something new for everything.... It's a totally new experience this week to travel all by myself to a land which I am not familiar with, for a 3 days trials on 2 criminal cases. Frankly speaking, I never conducted any criminal trials before. All I did before was to help someone to mitigate and this time round, 2 criminal trials .... It's something very 'new' (practically). I am not very sure when was the last time I open up my criminal procedure code for some reading of the prosedure.... and all I got now in my mind are those theoritical studies I got when I needed for my CLP exam which was about 9 years ago? ...
Not only at work that I experience something new... it's very 'new' after such a long time, that I am staying with someone. Good thing is... with someone I am close to. hahahaha... otherwise, ghoosh.... I think I will not be able to adopt so easily.
It's a totally new experience to me to receive such a huge amount of money today... as this month's commissions. I have however yet to determine from which files they are from. hahahaha....
It's a totally new experience that I visited the prison at Kota Kinabalu for the first time... It's a totally new experience!
Oh well... by looking at my surrounding... and seriously... I can't stop thanking Him for His mercy and grace. He is indeed good all the time! Despites all those I got through and am going through...
