Different kind of client...

I didn't get much work done today as I was meeting one of my client... who question me about, whether we should do this and that, whether we should file this and that and what our opponent can and will do, etc... and my client, gave me the feeling that, she is 'afraid' or 'shy' to claim for what she is entitle for. I have to convince her that based on what she told me, and the injuries that her daughter is suffering due to the negligence of the company, she has a case to win but we need to file some documentation to justify our claims and so on. But she still feel we are too 'bad' in a way to make the claim.

The other client ... was yesterday's case's client... the judge is asking us to come out with a figure... and my opponent has sent me an sms since morning offering 1.8Mil instead of 2.1mil that we are asking for and if both parties can agreed on 1.8 mil, then problem solved. Trust me, not that I want to agree with 1.8mil and settle the case just that.... but I am troubled by both parties since morning as they cannot agree to a price between 2.1mil to 1.8 mil. Offer is 1.8mil, my client said it is too low, ask for 2mil. Then the other party said no to it and we offer again to 1.9mil. still not acceptable.... to my client, she thinks..... she is 'entitle' for the claim.... but to the judge and my opponent... the question of 'on what basis' arose.... and so the argument goes.... I have advised her accordingly as to the possibility of not even getting anything at all at the end if the judge is angry....

Well, I got to make her come to my office and do another time of explaination tomorrow... I am asking for mercy... seriously. I don't want to make her think that I am forcing her... but I need to advise her accordingly....

Some people.... like my 2nd client... will think they have the 'rights' over things and that they don't need to bother what the judge will say, etc.... I too got the hint that my opponent will definately going to appeal if I win the case. Errrg....

Client.. I don't know if I should like them or hate them sometimes....

It was scheduled for review on all the submissions we submitted yesterday and hence, the board clearly stated, it's a chamber matter in the High Court. I therefore, did not bring my gaun up to the 3rd floor court room but leave it in the car. Just about 10 minutes before the court starts, I was informed that it's in open court, but the court clerk realised too that it's suppose to be in chamber and so they helped me to ask permission to appear before the Judge without the gaun. Then, it wasn't really a review, but a series of questioning of what we have submitted, etc. Seriously, I do not want to know which side the Judge is siding... he should have come up with his own decision by now. But instead, he questioned us a few questions, asked us to explain things, ask my opponent even to file in authorities in support of his 'allegation', which I am very much think it's unfair. After all, the trial is over more than a month ago and the submission and replied all have been filed. Anyway, he is the judge.... of course the 'spices' was that I was scolded and my opponent was scolded and seriously, we wouldn't be scolded so much if my opponent just shut up... but he loves to talk... hence.... all the scolding for almost 2 hours....

After the 2 hours, I rushed back to office to get my laptop as I have cell meeting last night... I went home, realised there's this agreement which need to be given to client very urgently. Hence, I started to draft it after my shower... while I was almost done, mom called.... (she always called me in a right time) and asked how's thing with me, etc. Told her I was scolded by judge and her first reaction was : "hahahahaha...."

I wasn't sure why she "hahahahaha..." but somehow, that "hahahahaha..." shows me that ... all the scolding is just NOTHING ... and it can be a joke too.... and it's temporary. Mom continues... said... working is like that... we get scolding but we learn from it... if the judge keep praising us, we won't learn... i thought for a while, true... he scolded, but he gave lots of input. I don't think I will make the same mistake again in my next case, if there is any....

Hmm.... it's a new day...and to prepare me to face this judge again on 27.08.2009.... i think I should remember "hahahahaha...".

Expectation?

I am not sure what's your expectation towards your lawyer... some would respect a lawyer, some think a lawyer is just a normal person and some, just think they are to do whatever you ask them to. I happen to meet all 3 kinds of those stated above and I have no problem being everybody's friends who seek for legal advice. Some think lawyer can give advice by just telling them a 'story'. Some think lawyer is to solve their problem. I don't deny the fact that a lawyer's job is to solve people's PROBLEM.

I had a good chat with a potential client this morning. Potential because he walked in with a client of mine, asking me about a problem he faces and of course even though they asked me to issue a letter on behalf I see no point of receiving such 'profit' at this point of time. Hence, I ask them to try issuing a letter themselves first and I can tell you, this potential client respect me of who I am, even though he is a big boss.

Some client like Mr. A... whom has pushed me to the end of the edge... to the point I have to really raise my voice when I speak to his secretary. I am not so sure if his secretary or him that I hate about, but I hate all the 'smart idea' pushed to me. i.e. We tried to serve a Subpoena to witness B last week and upon serving to witness B, I received a letter yesterday telling me that witness B cannot attend court as he will be away for an international conference from today until 14 of August 2009. Upon receiving such letter, I have written a letter to the Court seeking for his direction on this matter yesterday. The suprise was... Mr. A's secretary called, asking me if we can issue a warrant of arrest to witness B to make sure that he comes to Court next week. I am no police I told him and only the Court will grant warrant of arrest. I can't do anything about it. Mr. A's secretary told me, Mr. A said it can be done. I told her I have never done this before and I don't think I wanna do this. She continue to said, Mr. A said it can be done ask me to do it. I told her again that I never said it can be done. If he think it can be done, he can do it himself. I told her all I can do was to write to the Court to ask for direction. She doesn't seems to understand.... and insisted that I can issue a warrant to the witness.

Seriously... I just don't like this case and I really want this case to be over and done with and never wanted to see Mr. A and his secretary anymore. Be it they pay me a larger sum... I will still say NO.
