Ruling...

Hmm.. I received a notice from the court yesterday at around 4:30pm asking me to go to the court together with the Plaintiff for the decision of one case. My opponent is a very nice man, he called to make sure I receive the notice. Well, was in court at around 9 thinking I was late, but only later I realise the notice says, 9:30am. hahaha.. anyway... I didn't win this case. I sort of knew it as at almost last minute, my client told me something which I have no more chance to reply on. Well, I told him then that his chance is slim then based on what the opponent put on and he's aware of it. Well, ... still, the pressure was there this morning. Hoping for a miracle to happen, but of course at the end, no miracle. hahaha... seriously, came back, rushed other things and talked to client about his case too and now, while I am sitting down thinking, I have no idea why am I feeling so 'stressless' over the lossing of this case. Hmm... may be all because he pay me less and therefore I don't feel 'guilty'? Well, well... I don't know. Compare to the last one I won... I felt in fact, upset over my poor submission... I am confused by my own feeling obviously.. hahahaha...

Oh well, I am almost done with other matters.... waiting for the courier man to come to pass me the documents for filing in Tawau. It has yet to come.... Oh yes, I am going to Tawau later in the afternoon for a case tomorrow morning... hehe.. home sweet home... !

Review!

I was scheduled to go for a doctor review on 04.11.2008 but I was outstation. With that reason, I took a few weeks to think of the issue of what I should do with my ankle as it seems like, physiotherapy doesn't help much. I went for review this afternoon. I was hoping that the doctor will agree with my suggestion to refer me to the general hospital for physio and any operation if needed. The doctor of course said he has no problem referring me to the general hospital but he reminded me that I probably have to wait for quite some time. Well, he again checked my ankle and he's quite sure it's the joint, the ligament that need some 'cleaning' or 'repair'. Hmm... well, since his only suggestion is to do a half and hour to one hour operation by putting a scope inside my ankle and do the operation, I asked about the price. Well, it's not cheap I must say hence, I was hesitated. He then asked if I am covered by any insurance and he offered to check it for me. Oh well, with a few minutes of checking and confirming and fixing of date, I am now schedule to go through an operation on this coming Thursday. Errrr.... I am told I will need to walk with clutches for a few days and I cannot drive for 2 weeks. Errrrr.... I am going to Tawau tomorrow afternoon for a case and will come back on Wednesday afternoon. I guess I will then have to settle all my works before I take a few days off. Otherwise, my partner is going to faint...

Oh well... aaaaaaaaaaaaaaaaaaaaarrrrrrrrrrrrrrrgggggggggggggggggggg!!!!!

Court this morning!

I was faxed a copy of the Notice for pre-trial case management last Tuesday and I was thinking it's only concern this matter this morning. However, just before I left office last Friday, I was being served a copy of the Plaintiff's Bundles of Authorities. I took the bundles in my hand and I starte wondering what happen to this case. I thought there must be an argument somewhere, but if there's an unsettled matter, why is there a pre-trial case management date being fixed. I was completely confused. I went into my partner's room asked her the possibility, just in case I missed out something within my knowledge. She found it weird too. hahaha.. Hence, for the whole weekend, I was thinking ... what could happen.

I reached the Court this morning and checked my case in the board and realise my case listed as No.1. I went inside the court and didn't see anyone, then, I saw some documents (similar to the one I received on Friday) and there, a person standing next to it. Without looking carefully, I asked if he is so and so... goodness, he must be angry by now as he's one of the well known lawyer in town and I couldn't even recognised him at all. His servant was standing next to him, helping him to dress up and passing him all his documents and I didn't manage to recognised him, can you believe that? Everyone came into the court addressing him and me? hahaha... well, shame on me...!!! Well, back to my story, then... the court interpreter came in and saw me and told me, besides the pre-trial case management matter, there is a hearing by the Plaintiff and the 1st and 2nd Defendants. Thereafter, she asked if I would like to go in together with 2 senior counsels for that hearing. I said yes and she said she will let me in because there will be 2 senior counsels giving submission and it's a good opportunity for me to learn something too. I agreed with her. Immediately, the 2 senior counsels came in and discussion between them goes on and on until they forgot my presence. I didn't want to interrupt them and only when our case were called, one asked the other if I am their assistant only then I told them who I am (I am acting for the 3rd Defendant) and they apologise to me, etc. hahaha.. well, it's an interesting submission by both parties really, but the way their submit in the court was so 'professional'.... and of course the judge was very polite and ethical too.

Hmm.. being with 2 senior counsels has made me thought of those days where I was brought to court my my senior and my boss... to assist them... (assist = carrying their files, books, etc... ) and seeing them submitting was stress free ... and I considered a blessed one because all my senior did brought me along before. Unless the rest of my fella colleagues.. my boss and seniors never bring them to court and hence, they learn less. Oh well, sacrifies needed though. In order for them to bring me to court, I have to help them with their research, drafting and so on. hehe... which I did quite a bit until most of the time if they can't locate me in my seat, I surely be in the library. hahaha..

Hmm... well, ... I really miss being with the senior counsels... hehehe...
